To refer to the statment of the FSC from 10th of June 2010,a second defence pleading of eurobinia was sent. That letter was supposed to comment repeatedly the perception of the current case, because the argumentation of the FSC seems to be unobjective and distorted.

Kurz vor dem Termin der Gerichtsverhandlung am 1. September 2010 reichte der FSC eine weitere Stellungnahme auf die Erwiderungsschrift von eurobinia ein. Wiederholt begründet der FSC seine Klage und seinen Anspruch auf der Ansicht eurobinia würde mit der nutzung des abgewandelten FSC Logos lediglich versuchen seinen Absatz zu fördern, jedoch keine erkennbare Kritik äußern.
Wie er zu solch einer Wahrnehmung kommen kann, ist uns rätselhaft.
Auch der unterschweillige Vorwurf, dass die Pressemitteilung ein Mittel wäre, um Werbung zu betreiben, finden wir in keiner Weise haltbar. Nach unserer Auffassung dient die Pressemitteilung lediglich dem Zweck der Information über den laufenden Gerichtsstreit und die Hintergründe. Ein werbender Zweck hinsichtlich des Absatzes eigener Produkte ist absurd.

Um zur Stellungnahme des FSCs vom 10. Juni 2010 Bezug zu nehmen, wurde eine 2. Erwiderungsschrift von eurobinia eingereicht. Darin sollte wiederholt die Wahrnehmung des Falls kommentiert werden, da die Argumentation des FSCs unsachlich und verschoben erscheint.

As mentioned in the defence pleading it seems to be totally open where the FSC is really based and registered legally. According to the official statement the FSC is registered at the following address:

So far our investigations could not proof that an office, a contact person or something is existent at that given address. Thanks to Google Street View (even it is disputed strongly) one will have an image of the place where FSC is officially settled:
That should be the head office of an international acting organization with more than 50 local offices?
If Google Street View is not totally wrong and the street number 422 is placed between 420 and 424 as customary, this should be the address where FSC is registered.

Meanwhile eurobinia has recieved a statement of FSC to its defence pleading. The content shows many issues which are doubtful and less court proof. Especially interesting is the reaction on eurobinia’s principal claim, namely to state were the FSC is based and registered.
Indeed the lawyers of the FSC refer in their statement to the legal notice of the FSC website. Words fail us…

The reason for a legal action for trademark infringement of FSC versus the robinia wood trading company eurobinia is a flyer published by eurobinia a while ago. By help of the flyer eurobinia is defending itself against attacks of several FSC loyal non-for-profit organisations, who were arguing, eurobinia may use wood from destructive exploitation because eurobinia is not FSC certified.
To clarify that this conclusion cannot be right, on the basis of eurobinias ecological approach alone, the flyer was released. Moreover eurobinia admits to the refusal of certification schemes like FSC, since the FSC is neither a warrantor of legal forestry nor an evidence for ecological and socially fair forest management.
To point out its attitude clear, and to clarify the public image of the FSC, eurobinia used the figurative trademark of the FSC , namely supplemented with a red frame and a line running diagonally to the top:
The FSC takes defensive by that figurative expression of opinion, so it files eurobinia for injunctive relief.
